It likely depends on how your state's law is worded.

Every person sixteen years of age or older operating or riding in a motor vehicle shall wear the safety belt assembly in a properly adjusted and securely fastened manner.

So, if I get pulled over and I'm not wearing the shoulder strap I "could" be issued a ticket I suppose because the seat belt is not "properly adjusted" Note the and, the seat belt has to be both properly adjusted AND securely fastened so you might not get away with arguing "but it's clicked in position".

In most cars the Lap and shoulder belt are one piece and you have no choice.

Probably. The usual rule is that you must wear the seat belt properly, which means that if it has both, then you wear both.
